Budget Committee
Friends of Asbury Park:
At the November 7th City Council Meeting, Terry Reidy, the City Manager, announced that he is seeking citizens to serve on a Budget Committee. I was excited to learn of this because in recent weeks, I have been working on a draft plan for a "Committee for Fiscal Responsibility." From his brief explanation of what he has in mind, I believe we are on the same page on this issue. I have included a copy of my draft plan below for your review and have submitted this plan to the City Manager, along with a short list of names of citizens that I feel should serve on this committee.
It is important for each of you to know why this committee is so necessary at this point in Asbury Park's development. Because of the failed policies of the Council majority, most specifically in regards to the Waterfront Redevelopment Plan and the Waterfront Redevelopment Agreement, our city is short $8 million dollars in tax revenue to cover our bills for 2007 and it is projected that we will be short $12.5 million dollars in 2008.
For those of you who are unaware, by this point in the redevelopment of the waterfront, we should have been close to having 1200 new condominium units (300 each year). To date, we have approximately 40. One cannot blame the most recent market shifts for this lack of performance. This is a matter of incompetence on the part of Asbury Partners and an unwillingness to play hard ball on the part of the Council majority.
These are the facts and we must deal with them. What is necessary now is clear leadership and direction to get our fiscal house in order. We must recruit the most qualified citizens to help the city reach the goals and objectives I have outlined below.

Mission:
The Committee for Fiscal Responsibility will advise the CFO, City Manager, and City Council to create an efficient, cost effective, and performance-orientated City government.
Goals:
1. To reduce overall spending by 5% for the 2008 fiscal year and 7.5% for fiscal year 2009.
2. To increase revenues by 5% for the 2008 fiscal year and by 7.5% for fiscal year 2009.
3. To establish a five-year strategic plan for the City government.
Objectives:
1. City Council will vote on the creation of this committee and appoint its members by December 31, 2007.
2. All City Departments will submit 2008 mission, goals, objectives and budgets by December 31, 2007 and project for their departments the goals and budgets for each fiscal year from 2009 through 2012.
3. The Committee will meet once a week beginning January 2008.
4. The Committee will review proposed 2008 mission, goals, objectives and budgets and recommend spending cuts and income enhancements for each department by February 15, 2008.
5. The Committee will develop a draft five-year strategic plan for revenues and expenditures in collaboration with the CFO and City Manager by March 15, 2008.
6. The City Council will review, revise and adopt a five-year strategic plan by April 15, 2008.
7. The Committee will meet monthly with the CFO and City Manager to review the implementation of the five-year plan to review its adherence to the department budgets and the income projections, and make recommendations for necessary adjustments.
Committee Membership:
One member from each of the nine voting districts in Asbury Park; two Asbury Park City Council members; two Asbury Park business owners; one member from the NJ Department of Community Affairs, one member from the NJ Treasurer’s Office.

Special Executive Session on the Waterfront Redevelopment
Friends of Asbury Park:
This Friday the City Council will be holding a special Executive Session meeting to discuss the state of the Waterfront Redevelopment. As I understand it, the goal of this meeting is to develop a collective vision and plan of action for the Waterfront in light of the current state of progress, market conditions, the City budget, etc.
By this point in the Waterfront Redevelopment, the Citizens of Asbury Park were promised at least 1200 new ratables (300 per year over 4 years) and $8,000 in tax revenue per ratable. To date, we have approximately 40 new ratables. This is despite the fact that Asbury Partners had the ability to develop waterfront property in Monmouth County in what was arguably the hottest four years in real estate development in our nation’s history.
This is an important time for your Councilmembers to hear from you. I have outlined below some important facts for you to review with regards to both the City Budget and the Waterfront Redevelopment. I am sure you will see why/how these are related.

Facts on the City Budget and the Waterfront Redevelopment
On June 20, 2007 the City Council approved a $ 35.5 million budget with a minimal increase in the City tax rate (not including county and school rate increases.) This amount is similar to last years; however, since the 2004 budget the City Council majority has increased spending by just over $8 million.
If the state had not come to the aid of certain City Council members’ pleas for help, our minimal tax bill increase would have been $2,685 per household, on an average assessed home of $150,000.
The City Manager has stated that, “It’s going to be a few years before we can balance a budget with our own revenues.”
Larry Fishman of Asbury Partners has stated that, “I think the city’s going to have to plug that gap ($7.5m) for another year.”
Asbury Park’s deficit was supposed to be eliminated back in 2002 when the city sold all of our waterfront properties and pavilions. Citizens were then told in 2005 that the surplus of $11million from the sale of the Sewer bond would go to “plugging the budget for the next three years.” As proof to support this bond and to gain approval, the City presented a report to the Local Finance Board stating that Asbury Park will have “annual recurring revenue beginning in 2006 to 2008 equaling $4.2 m in phase 1; (and) phase 2 will be on line in 2008-2009 with an additional $4.2m.”
The following is a list of deficiencies on the part of Asbury Partners under the terms of the recent Dispute Resolution Agreement:
A. Convention Hall (Schedule B)
(i) Window Replacement Program. The window replacement program was to be completed in May 2007. Asbury Partners subsequently indicated that this program would be completed by September of 2007. On May 31, 2007, Asbury Partners indicated that the condition of the window openings necessitated repair of those openings and that fabrication of the replacement windows would be deferred until the details of the necessary repairs were completed. The Recent Submission indicates that reconstruction of the window openings has begun but there is no definitive completion date.
(ii) Interior Store Replacements. Interior Store Replacements were to be completed in September of 2006. An updated projection by Asbury Partners’ representatives was July 2007. To date, this work has not commenced. On April 19, 2007, Asbury Partners indicated that a bid award was expected on April 20, 2007. The Recent Submission indicates that construction will commence in September and be competed in December of 2007. However, the City is still awaiting indication that the SHPO has approved the interior storefront design.
(iii) Arcade Entrance Structure Repair. This work was to be completed by May 2007. Revised projections from Asbury Partners’ representatives were that the work would commence in early April and would be completed in August 2007. On May 31, 2007, Asbury Partners indicated that revisions were necessary to existing plans and that a permit modification would be applied for. The Recent Submission indicates that construction will start in mid-September, and be completed in December 2007.
(iv) Exterior Store Fronts and Entry Doors. This work would be completed in April of 2007. To date, this work has not been commenced. On May 4, 2007, Asbury Partners indicated that an extension for submitting bids was granted with the new deadline being May 18, 2007. The Recent Submission lacks any definitive timeframe for the completion of the work.
(v) Entire Building Renovation Design. Construction documents were to be complete in September 2007 with renovation work to begin in October 2007. To date, Asbury Partners has not undertaken the schematic design which was scheduled to be complete in January 2007. The Recent Submission does not indicate any definitive timeline for this work.

1. Arcade
(i) Entire Building Renovation Design. Schedule C indicates that construction documents are to be complete in September 2007 and that renovation is to commence in October 2007. a. Asbury Partners has not complied with the City’s timely demand for the funding of escrow payments necessary to pay City personnel, as set forth in Item numbered 7.
b. Asbury Partners has not submitted to the City its annual reports to N.J.S.H.P.O relating to the Convention Hall and Paramount Theater as required by the Historic Preservation Easements since April 7, 2006, in accordance with its obligation under Schedule F of the Dispute Resolution Agreement. The Recent Submission indicates that this work is in progress.
c. Asbury Partners failed to move the Palace Amusement Murals by August 1, 2006 or comply with the recommendations of conservator, Paul Himmelstein. Construction activities have begun at the Wastewater Treatment Plant, subjecting the murals to an increased chance of damage. The Recent Submission indicates that a September 2007 move is planned.
In addition to the above, there also are joint issues that must be addressed by the parties as more specifically set forth in Schedule F of the Dispute Resolution Agreement. For example, the parties must resolve Schedule F Item number four relating to the transfer of Green Acres parcels to the City subject to an agreement regarding approved uses. Further, the City and Asbury Partners must resolve issues relating to Schedule F Items numbered 9 and 10 dealing with the dispute regarding the taxation of Block 227 and the determination of the sale price for Block 222, respectively.
In addition to Asbury Partners’ failure to comply with obligations under the Dispute Resolution Agreement, they have also failed to satisfy the following material obligations under the Redeveloper Agreement.
1. Redeveloper’s failure to construct the beach clubs in accordance with Section 3.13.
2. The failure to complete work in connection with the re-opening of Sixth Avenue in accordance with Section 3.15.
3. The failure to make any “good faith” effort with respect to the integration of the Charms Building into any development by a subsequent developer in accordance with Section 3.16.5,
4. The failure to continue to implement the infrastructure improvement master plan as presented and accepted to the Mayor and Council in 2005.

The Jersey Shore Writer’s Studio (JSWS) is a comfortable, supportive environment created specifically with the writer in mind. The Studio is open to all theatre artists who would like to collaborate in a creative atmosphere to develop a play, screenplay, short story, memoir, etc and who wish to hear their words read by members of the Studio. Tourism and Asbury Park
Friends of Asbury Park:
In the past day or so a number of people have been posting to one of the local listserves here in Asbury Park about tourism and our City. In light of what has been written, and also in light of the new life Madison Marquette has brought to our waterfront, I thought I would repost a portion of “The Keady Report” from January 2006 that speaks to this topic. I offer it to keep alive the current conversation about refocusing our efforts to establish Asbury Park as THE premier tourist destination on the Jersey Shore. As you read, I ask you to take particular note of the statistic about accommodations. Asbury Park will need hotels and guest houses to capture these tourist dollars. A bedroom condo community will not serve this purpose.

Re-focusing on Tourism
In preparations for the January 27th meeting with Asbury Partners I did some cursory research on tourism in New Jersey. I undertook this research because in my gut I just did not believe the argument that Asbury Partners and our own Redevelopment Attorney, Jim Aaron, were making that “retail redevelopment must always be preceded by significant residential development for it to be successful.” This was one of the defenses for Asbury Partners lack of action on the boardwalk properties. They were basically saying that there needed to be more people living near the boardwalk to make the properties commercially viable. I did not buy it when they first said it and now that I have some numbers to back up my gut feeling, I am quite confident in my position.
The simple fact is that we have one mile of beautiful beaches and that if we create a safe, attractive boardwalk, there will be more than enough tourism to support the investments made to redevelop the Pavilions, Conventional Hall, the Paramount Theater and the Casino Complex.
To support my case, here are some facts from the NJ Commerce, Economic Growth and Tourism Commission.
* The economic impact of the Travel and Tourism Industry in New Jersey contributes $30 billion dollars in economic activity each year and creates 416,000 jobs.
* In 2003, 65 million people visited New Jersey and tourism generated $2.9 billion in state and local government revenues.
* Of the dollars spent on tourism in New Jersey, accommodations account for the largest share (37%), followed by food (26%), shopping (16%), transportation (10%) and entertainment (7%).
* Nowhere is the impact of the Travel and Tourism industry more evident than at the JERSEY SHORE. The four counties that make up the Shore (Atlantic, Cape May, Monmouth and Ocean) account for more than 72% or $21.6 billion in annual economic activity.
Could you imagine if Asbury Park were able to garner just 5% of the travel and tourism industry in NJ? That would be an influx of $1,500,000,000 into our local economy. This is why we need to seriously reconsider the focus of our efforts on the oceanfront and maximize our beaches, our brand name and our music history to create a first class tourist destination.

Summer Soccer Program Starts Monday!
Friends of Asbury Park:
The Asbury Park Soccer Club will be starting its Summer Soccer Program this Monday, July 9, 2007. This year the club has partnered with UK Elite Inc. to provide a dynamic soccer experience for the kids of Asbury Park.
From personal experience, I can share that the coaches and staff of UK Elite are top rate. I am really excited about them teaching the game of soccer to our kids. This should be the best summer soccer program we have had yet.
The program is open to players of all skill levels, including beginners. It will run for seven weeks and will be held on Monday evenings at the Asbury Park High School Soccer Field. The playing times and respective age groups are as follows: Boys and Girls Ages 5-8 will play from 5:30-6:30pm; Boys and Girls Ages 9-12 will play from 6:30-7:30pm; and Men and Women Ages 18 and up will play from 7-8:30pm.
The registration fee for the program is $10 and participants must be residents in Asbury Park. Registration will be conducted this Monday night prior to the start of the program.
The Asbury Park Soccer Club is also still in need of volunteers to help facilitate the program. No prior soccer experience is necessary. If you are interested in being a volunteer or would like more information about the program, please contact me at 732.502.5196.

Dear Friends of Asbury Park:
At the May 23, 2007 Regular Meeting of the Asbury Park City Council, the 2007 Municipal Budget was introduced. The proposed 2007 budget is $35.4 million dollars. To generate the revenue needed to cover this budget, it has been proposed that taxes be increased by 5% above the current rate.
When the budget introduction was put to the floor for a vote, I asked the following questions:
What does a 5% tax increase mean for the average homeowner?
Here is an example to answer this question. If someone's home was assessed at $150,000, the 5% increase in their tax bill would amount to roughly $180.
What does this increase represent in real dollar terms in the budget?
There is currently a revenue shortfall of $500,000 for the proposed 2007 budget. It is being proposed that this shortfall be made up by the 5% tax increase.
What cuts (if any) have been made by our respective departments?
The staff was not prepared to answer this question at the May 23rd meeting.
In light of the answers given to my questions, I made the comment that I did not think it was fair for the taxpayers of Asbury Park to be burdened with a 5% tax increase without a complete justification of the increased spending by our City Departments. I then asked my colleagues if they were interested in having each department walk us through their proposed budget. The entire Council agreed this was a good idea and we are having a special public meeting tomorrow to go through this process.
Once we review the budget, we must decide as a community:
Are we willing to pay 5% more in taxes to cover the costs of what is being proposed by our City Departments?

Dear Friends of Asbury Park:
At the May 23, 2007 Regular Meeting of the Asbury Park City Council, the 2007 Municipal Budget was introduced. The proposed 2007 budget is $35.4 million dollars. To generate the revenue needed to cover this budget, it has been proposed that taxes be increased by 5% above the current rate.
When the budget introduction was put to the floor for a vote, I asked the following questions:
What does a 5% tax increase mean for the average homeowner?
Here is an example to answer this question. If someone's home was assessed at $150,000, the 5% increase in their tax bill would amount to roughly $180.
What does this increase represent in real dollar terms in the budget?
There is currently a revenue shortfall of $500,000 for the proposed 2007 budget. It is being proposed that this shortfall be made up by the 5% tax increase.
What cuts (if any) have been made by our respective departments?
The staff was not prepared to answer this question at the May 23rd meeting.
In light of the answers given to my questions, I made the comment that I did not think it was fair for the taxpayers of Asbury Park to be burdened with a 5% tax increase without a complete justification of the increased spending by our City Departments. I then asked my colleagues if they were interested in having each department walk us through their proposed budget. The entire Council agreed this was a good idea and we are having a special public meeting tomorrow to go through this process.
Once we review the budget, we must decide as a community:
Are we willing to pay 5% more in taxes to cover the costs of what is being proposed by our City Departments?
If we are not willing to pay 5% more, is there a way to generate revenue from other sources to cover the increase?
If we are not willing to pay 5% more, and there are no other sources of revenue, what do we want to cut from the proposed budget?

Should Asbury Park Use Video Cameras in High Crime Areas?
Dear Friends of Asbury Park:
In response to a letter I received from a constituent this week about the recent vandalism in Library Square Park, I sent a memo to the City Manager and to the Police Chief today requesting the following:
Can the Police Department please prepare a report for an upcoming Workshop Session about placing cameras in known high crime areas (Library Square Park, Bangs and Prospect, Washington Avenue, etc.)?
While I am awaiting a response from the City Manager and Police Chief to this question, I am interested in hearing from as many residents as possible about this issue.

The experience of hearing a character come alive is a critical step in the process for the writer. In support of that idea, an important component of the JSWS is the intense collaboration between writer and actor. JSWS is an opportunity to develop new work, fine-tune existing work and provide a creative and nurturing home for the aspiring writer.

Dinner to Honor Mr. Frank Budd
Dear Constituents,
I am writing to invite you to take part in honoring Mr. Frank Budd, arguably, the greatest athlete to ever grace the Asbury Park athletic scene.
Many of you may be aware that on October 30, 2006 the Asbury Park Board of Education passed a resolution naming the Asbury Park High School Track and Field Oval after Mr. Budd. In light of this action, on February 23rd a dinner will be hosted by the Shore Athletic Club at the Jumping Brook Country Club in Neptune, NJ, with proceeds benefiting the Frank Budd Memorial Scholarship and to help erect a monument in Mr. Budd’s honor at the Asbury Park High School Stadium.
For those of you who may be unfamiliar with Mr. Budd’s athletic accomplishments, Frank graduated from Asbury Park High School in 1958. During his time as a Blue Bishop, Frank was a member of the Varsity Basketball Team, was a First Team All-State Football player, and an All-American Track and Field performer.
Frank attended Villanova University on a full athletic scholarship and was a three time NCAA track champion. He participated in the 100 and 200 yard dashes, the 4x100, 4x200 and the mile relay. In 1960, while still a student at Villanova, Frank made the United States Olympic Team and competed in the Olympic Games in Rome, Italy in the 100 yard dash, for which he was a finalist, and as a member of the 4 x 100 relay team.
In 1962 Frank broke the 20-year-old 100 yard dash record of 9.3 seconds by running a new world record of 9.2 seconds. After this feat, Frank Budd was dubbed “The Worlds Fastest Human Alive.”
After Frank’s graduation from Villanova University in 1962, he played professional football for the Philadelphia Eagles, Washington Redskins and did a stint in the Canadian Professional Football League. Frank has since been selected by the Asbury Park Press as “Athlete of the Century” and was inducted into the Asbury Park High School distinguished Alumni Hall of Fame in 2003.
Given all his accomplishments it is clear why we should honor Mr. Budd and hold him up as a role model for our children in Asbury Park. You can participate in honoring him in the following ways. SUNDAY, JANUARY 14TH @ 4PM
FIRST UNITED METHODIST CHURCH

ASBURY PARK, NJ
Associate Pastor Gil Caldwell and First United Methodist Church, First and Grand Avenues, Asbury Park are hosting their Martin Luther King Observance: "THE WORDS of MARTIN LUTHER KING and THE SOUNDS OF MUSIC as played by Vinnie Carrao and friends; Jazz and Gospel. Martin Luther King in his address to the 1964 Berlin Jazz Festival, said "God has wrought many things out of oppression. We have been endowed with the capacity to create - and from this capacity has flowed the songs of sorrow and joy that allowed us to cope...Jazz has been a stepping stone to this." The public is invited to this FREE event.

Porter Brown of Asbury Park. The national theme for club’s events is “Remember, Celebrate, Act: A Day On - Not a Day Off.” The local theme is “Stand Up and Speak Out for Justice -Because Freedom Cannot Defend Itself.”

Spirit of Truth World Vision Outreach presents the 2nd Annual "Keeping the Dream Alive" Rev. Dr. Martin Luther King Jr. Day Community Celebration to celebrate the life and contributions of Dr. King. This event is free and open to the public. All are welcome. The event will feature readings, quotations and commentaries of Dr. King, read by a diverse assembly of Ministers, City Officials and Community Activists from Asbury Park. There will also be performances by local singers, poets, dancers, choirs, and rappers. A free hot dinner will be served and there will be a distribution of free canned goods, boxed food, new hats and gloves, and a toy giveaway for children 10 and under.

Battle at the Boardwalk at Convention Hall
Dear Constituents,
Happy New Year! I hope everything is going well for you thus far in 2007. I am writing to encourage you to attend the Battle at the Boardwalk basketball event that will be taking place this weekend at Convention Hall. The full schedule of games can be found at:

The event kicks off with our own Asbury Park Blue Bishops Boys team, who are currently undefeated and ranked #5 at the Shore, taking on the Neptune High School Scarlet Fliers, who are currently ranked #2 at the Shore and #20 in NJ.
This is a great opportunity for all of us to get out and support our kids and show our Asbury Park spirit.
